AGREEMENT TO OUR LEGAL TERMS

We are VICTOBA ("Company," “we,” “us,” or “our”), a company registered in Ghana. 

We operate the website www.victoba.com (the “Site”), as well as any other related products and services that refer or link to these legal terms (the “Legal Terms”) (collectively, the “Services”)

These Terms and Conditions (“Terms”) govern your use of our website, products, and services (the “Services”). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.

 We may revise these Terms from time to time at our sole discretion. Your continued use of the Services after the posting of any revised Terms constitutes your acceptance of those changes. We recommend reviewing these Terms periodically to remain informed of any updates.

Eligibility

You must be at least [18] years old, or the legal age of majority in your jurisdiction, to use our Services. By using our Services, you represent that you meet these requirements.

2. You may not attempt to disrupt, interfere with, or gain unauthorized access to our systems.
3. We reserve the right to suspend or terminate accounts that violate these Terms.

2. INTELLECTUAL PROPERTY RIGHTS

 Our intellectual property

We are the owner or the licensee of all intellectual property rights in our Services, including all source code, databases, software, designs, text, images, audio, video, and graphics (the “Content”) as well as all trademarks, service marks, and logos (the “Marks”).

The Content and Marks are protected by copyright, trademark, and other intellectual property laws. They are provided through the Services “as is” for your personal, non-commercial use (or internal business use, if applicable) only.

Your use of our Services

As long as you comply with these Terms (including the “Prohibited Activities” section), we grant you a limited, non-exclusive, non-transferable, and revocable license to access the services.

No part of the Services, Content, or Marks may be copied, reproduced, published, distributed, sold, licensed, or otherwise used for any other purpose without our prior written consent. If permission is granted, you must credit us as the owner or licensor and display any copyright or proprietary notices as required.

We reserve all rights not expressly granted to you. Any breach of these rights will be considered a material violation of these Terms and may result in immediate termination of your access to the Services.

Your submissions and contributions

This includes the right to use your name, trademarks, and logos, if provided.

Please review this section and the “PROHIBITED ACTIVITIES” section carefully prior to using our Services to understand the (a) rights you give us and (b) obligations you have when you post or upload any content through the Services.

 Your Responsibilities

3.  Be illegal, harmful, defamatory, obscene, harassing, hateful, or discriminatory;
4. Contain false, misleading, or confidential information; or
5.  Infringe on the rights of any third party.

You confirm that you own or have the necessary rights to share your Submissions and Contributions. You are fully responsible for anything you post or upload and agree to compensate us for any loss or damage caused by your breach of this section.

Our Rights

Although we are not required to monitor Contributions, we may remove or edit any content at any time if we believe it violates these Terms or is otherwise harmful. We may also suspend or disable your account and, where necessary, report violations to the appropriate authorities.

3. USER REPRESENTATIONS

By using the Services, you confirm that:

1. All information you provide during registration will be true, accurate and complete.
2. You have the legal capacity to agree to and comply with these Terms.
3. You are not under 18 years of age.
4. You will not access the Services through automated means (such as bots or scripts).
5. You will not use the Services for any unlawful or unauthorized purpose.
6. Your use of the Services complies with all applicable laws and regulations.

If you provide false, outdated, or incomplete information, we may suspend or terminate your account and deny you future access to the Services. 

4.  USER REGISTRATION

You are required to create an account to access our Services. You agree to keep your login credentials confidential and are responsible for all activity that occurs under your account.

We reserve the right to remove any username if we determine, at our sole discretion, that it is inappropriate, offensive, or otherwise objectionable.

5. PURCHASES AND PAYMENT

All purchases made through the Services are subject to the pricing and terms displayed at the time of purchase. Each package or service offered comes at a stated cost, which must be paid in full through the payment options provided on the system.

We reserve the right to modify prices at any time, at our sole discretion. Any price changes will apply to future purchases and will not affect orders already completed.

By completing a purchase, you agree to provide current, complete, and accurate payment information and authorize us to charge your selected payment method for the total amount due.

6. EVENT ACCESSIBILITY

By using the Services, you agree that events created will remain accessible for a limited period after they go live. The duration of accessibility depends on the type of event:

1. VICTOBA Celebrations and VICTOBA Funerals: Accessible for seven (7) days after the event has ended.
2. VICTOBA Conferences: Accessible for thirty (30) days after the event has ended.

After the applicable period, access to the event and its related services, including invitations, files, and other associated content, may no longer be available.

We encourage you to download, save, or otherwise secure any information or materials you wish to retain during the accessibility period. We are not responsible for the loss of any event-related data or content after the designated accessibility period has expired.

If you wish to extend the accessibility of your event beyond the default period, you must contact our support team at (+233) 20 982 9299 or [email protected], before the expiration date to request an extension. Extensions will be provided at additional charges, the amount of which will depend on the duration of the requested extension. All extension payments are final and non-refundable.

7. PROHIBITED ACTIVITIES

 You can only use our Services for their intended purpose. You are not allowed to use them for anything illegal, harmful, or not approved by us.

 By using our Services, you agree NOT to:

1. Collect data, content, or information from our Services to build your own database or directory without our permission.
2. Collect usernames or emails to send spam, or create fake accounts.
3. Bypass or interfere with our security features or try to copy protected content.
4. Link to or frame our Services without permission.
5. Trick, scam, or mislead us or other users (especially to get passwords).
6.  Abuse our support services or send false reports.
7.  Use bots, scripts, or other automated tools to interact with the system.
8. Interfere with or overload our Services or connected networks.
9.  Pretend to be someone else or use someone else’s account.
10.  Use any information from the Services to harass or harm others.
11.  Use the Services to compete with us or make money in ways we haven’t approved.
12.  Reverse engineer, copy, or tamper with our software or code.
13.  Try to bypass access restrictions or security measures.
14.  Harass, annoy, or threaten our employees or agents.
15.  Remove copyright or ownership notices from content.
16.  Upload viruses, spam, or anything that disrupts the Services.
17.  Upload spyware or hidden tracking tools.
18.  Use unauthorized automated systems like scrapers, bots, or cheat tools.
19.  Speak badly about or harm our reputation.
20.  Break any laws while using the Services

8. GUIDELINES FOR REVIEWS

We may let you leave reviews or ratings on our Services. If you do, please follow these rules:

1.   Don’t use profanity or hateful, abusive, or offensive language.
2.  Don’t include discrimination based on religion, race, gender, nationality, age or disability.
3.  Don’t mention illegal activities.
4.  Don’t post negative reviews if you work for or are connected to a competitor.
5.  Don’t make legal claims or accusations.
6.  Don’t post anything false or misleading.
7.  Don’t organize others to post mass reviews (positive or negative).

 We may remove or reject reviews at any time, but we’re not required to monitor or delete them. Reviews do not represent our opinions, and we aren’t responsible for any damage or issues caused by them.

 By posting a review, you give us permission to use it (forever, anywhere, for free), including copying, translating, displaying, sharing, or modifying it.

9. SERVICES MANAGEMENT

We have the right (but not the obligation) to:

1. Monitor the Services to make sure these Legal Terms are being followed.
2. Take legal action against anyone who breaks the law or these Terms, including reporting them to the authorities.
3. Limit, block, or disable any of your content (or part of it) if we think it’s necessary.
4. Remove files or content that are too large or put too much strain on our systems.
5. Manage the Services in any way needed to protect our rights, property, and ensure everything works properly.

10. PRIVACY POLICY

We care about data privacy and security. Please review our Privacy Policy. By using the Services, you agree to be bound by our Privacy Policy, which is incorporated into these Legal Terms.

 11. TERM AND TERMINATION

 These Terms stay in effect as long as you use our Services.

We have the right to deny access to anyone, with or without notice, for any reason, including if you break these Terms, break the law, or for no specific reason at all. This may include blocking your IP address, deleting your account, or removing any project you’ve created.

If we suspend or terminate your account, you are not allowed to create a new one, whether under your own name, a fake name, or someone else’s name (even if you claim to act for them).

We also reserve the right to take legal action if necessary, which could include civil, criminal, or court action.

12. USER DATA

 We keep some of the data you send to us so we can manage and improve the Services. We also keep information about how you use the Services.

Even though we regularly back up data, you are responsible for your own data.

If any of your data is lost or damaged, we are not responsible for that loss, and you agree not to take legal action against us for it.

13. ELECTRONIC COMMUNICATIONS, TRANSACTIONS, AND SIGNATURES

 When you visit our Services, send us emails, or fill out online forms, you are communicating with us electronically. By doing so, you agree to:

1. Receive communications from us electronically (by email or on the Services)
2. Treat all agreements, notices, policies, and other communications we send electronically as if they were in writing.
